Terms of Service

Repair Terms and Conditions

Green Mountain Geek will repair your product as described and for the charges shown on your estimate (unless such charges are revised with your oral or written consent). When the product is covered by warranty or an extended service contract, then you need to contact the manufacturer directly that governs the warranty. You will be responsible for any additional charges applicable under your product’s warranty or extended service contract described on your estimate form, including any applicable tax or shipping fees. Green Mountain Geek may subcontract with other service providers for the repair of your product.

Repair and Diagnostic Fees

A diagnostics fee will be applied for all computer/device repairs. If you choose to proceed with the recommended repair or services, the diagnostics fee will be applied toward the total repair costs on the final invoice. Diagnostics fees are not refundable. Any changes to the scope of work will be discussed and agreed upon with the customer before proceeding. We are not responsible for any pre-existing conditions or issues that may be discovered during the repair process. The diagnostics fee are NONE REFUNDABLE, and cannot be combined with any other offers, discounts or promotions and is due upon completion of the diagnostics.

Warranty Repairs

When your product is covered by manufacturer warranty or an extended 3rd party service contract, then you need to contact the manufacturer directly that governs the warranty.

You will be responsible for any additional charges applicable under your product’s warranty or extended service contract described on your estimate form, including any applicable tax or shipping fees.  Green Mountain Geek does not provide manufacturer or 3rd party vendor warranty repairs.

Green Mountain Geek Liability

TO THE MAXIMUM EXTENT PERMITED BY LAW, GREEN MOUNTAIN GEEK AND  AFFILIATES, WILL UNDER NO CIRCUMSTANCES BE LIABLE FOR ANY SPECIAL, INDIRECT, INDCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM PERFORMANCE OF ANY REPAIR SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE; LOSS OF ACTUAL OR ANTICIPATED PROFITS (INCLUDING LOSS OF PROFITS ON CONTRACTS); LOSS OF THE USE OF MONEY; LOSS OF ANTICIPATED SAVINGS; LOSS OF BUSINESS; LOSS OF OPPORTUNITY; LOSS OF GOODWILL; LOSS OF REPUTATION; LOSS OF, DAMAGE TO, OR CORRUPTION OF DATA; OR ANY COSTS OF RECOVERING, PROGRAMMING, OR RESTORING ANY PROGRAM OR DATA STORED OR USED WITH YOUR PRODUCT AND ANY FAILURE TO MAINTAIN THE CONFIDENTIALITY OF DATA STORED ON YOU PRODUCT. THE FOREGOING LIMITATION SHALL NOT APPLY TO DEATH OR PERSONAL INJURY CLAIMS. GREEN MOUNTAIN GEEK SPECIFICALLY DOES NOT WARRANT THAT IT WILL BE ABLE TO (I) REPAIR OR REPLACE YOUR PRODUCT WITHOUT RISK TO OR LOSS OF PROGRAMS OR DATA, AND (II) MAINTAIN THE CONFIDENTIALITY OF DATA. IF ANY PRODUCT SHOULD BE DAMAGED OR LOST WHILE IN GREEN MOUNTAIN GEEK CUSTODY, GREEN MOUNTAIN GEEK LIABILITY WILL BE LIMITED TO THE COST OF REPAIR OR REPLACEMENT OF THE AFFECTED PART. GREEN MOUNTAIN GEEK IS NOT LIABLE FOR LOSS OR CORRUPTION OF DATA OR YOUR CONFIDENTIAL, PROPRIETARY OR PERSONAL INFORMATION OR REMOVEABLE DATA. BEFORE YOU BRING YOUR PRODUCT IN FOR ANY REPAIR SERVICE, YOU SHOULD MAKE A BACKUP COPY OF YOUR DATA AND REMOVE ANY CONFIDENTIAL, PROPRIETARY OR PERSONAL INFORMATION AND REMOVEABLE MEDIA SUCH AS FLOPPY DISKS, USB FLASH DRIVES, EXTERNAL CD/DVD DRIVES, CDS OR PC CARDS.

 

Social Media Posting and Disagreements

You understand our professional reputation as a professional service repair provider is very important to our business. You agree that if we have a disagreement regarding my services, fees, or other issues, you will work with Green Mountain Geek to resolve the disagreement. You agree if we are unable to resolve a disagreement, you will not disparage Green Mountain Geek or firm(s), which includes not posting any negative review of Green Mountain Geek or firm on any social media platforms such as Facebook, Google, LinkedIn, Yelp, etc. If you breach this term of  agreement, our firm(s) and I will suffer undeterminable economic damages and you agree to pay Green Mountain Geek $3,500 as liquidated damages, and not as a penalty. You agree that Green Mountain Geek can charge this amount of liquidated damages to your credit card on file with our firm.

Additionally, should you breach this term of our agreement by making a posting, you waive your rights to privacy with respect to any information reasonably deemed warranted to respond to any inaccuracies or falsehoods of such posting.

Revised Estimates

If the requested repairs require labor and/or parts not specified on your estimate receipt, Green Mountain Geek may seek your approval of a revised estimate. If you do not agree that Green Mountain Geek may revise the charges, Green Mountain Geek may return your product and hold you responsible for any possible diagnostics fee and including the labor fee shown on your estimate receipt, plus any applicable tax.

Used Parts

Green Mountain Geek may use new, used or reconditioned (refurbished/pre-owned) parts. Green Mountain Geek will retain the replaced part that is exchanged under repair service as its property, and the replacement part will become your property. Replaced parts may be repairable and are exchanged or repaired by Green Mountain Geek for value. If applicable law requires Green Mountain Geek to return a replaced part to you, you agree to pay Green Mountain Geeks the additional cost of the replacement item.

None Warranty Repairs

If your product is repaired outside of warranty, Green Mountain Geek warrants that the repairs will be performed in a competent and workman like manner and that all parts used (new, refurbished or pre-owned) to repair your product will be free from defects in materials and workmanship for a period of thirty (30) days, unless otherwise specified by Green Mountain Geek.

Your Data

If repair service involves transferring files or data (no programs or applications), you represent that you have the legal right to copy the data and agree to the terms of the software license, and you authorize Green Mountain Geek to backup and transfer the data (no programs or applications or licenses) and accept such terms on your behalf in performing the service.

Data License

Green Mountain Geek will NOT install any licensed programs or applications (purchased or free) on clients computer (desktop, laptop, notebook, tablets, iPhones, mobile phones, or server). Client is responsible on installing all their programs or applications on their electronic devices period. It is client responsibility to backup the license(s) of any programs or applications (like Microsoft products, AntiVirus, iTunes, Adobe etc.). Green Mountain Geek will not be held liable if any of the license(s) are lost or erased during any hardware or software repair and upgrade.

Claim Back Device

If you have not claimed your product and have not paid all charges due within ten (10) days after being notified by Green Mountain Geek that your product has been repaired, Green Mountain Geek will  consider your product abandoned. Green Mountain Geek will provide such notice to you at the email address you furnished when you authorized the repairs. Green Mountain Geek may dispose of your product in accordance with applicable provisions of law, and, specifically, may sell your product at a private or public sale without liability to you. Green Mountain Geek reserves its statutory and any other lawful liens for unpaid charges.

Deposits

Some repairs require a deposit before ordering parts or to start a repair project. All deposits that are collected are none-refundable. The deposit will be applied to your final invoice once the repair is completed. In some cases, after collecting the deposit, the part(s) might get cancelled or updated by the vendor or by client. In such cases a 30% return fee will be deducted from your deposit and the remaining balance of the deposit will be credited to your account for any future projects or repairs

Payments

Green Mountain Geek accepts cash, checks, and credit/debit card payments. All payments are subject to 4% processing fee which will be added to your final invoice. 

All payments are due after repair is completed and before picking up your device. Credit card processing fees are none refundable..

Late Fees

Green Mountain Geek charges $10 per day storage fee if you do not pickup your device within 5 business days of notification of completion by Green Mountain Geek.

Green Mountain Geek charges a late fee of minimum $20 or 10% of the invoice amount (which ever is greater) for any invoices that are past their due date.

Laws

These Terms and Conditions are governed by the laws of the State of Vermont (without giving effect to its conflict of law provisions). If any provision of these Terms and Conditions is held to be illegal or unenforceable, that provision will no longer be part of the Terms and Conditions, and the Terms and Conditions will be enforceable as though that provision never was a part of them.

Agreement

You agree and understand that it is necessary for Green Mountain Geek to collect, process and use your data in order to perform the service and support obligations under these Terms and Conditions. Green Mountain Geek will protect your information in accordance with Green Mountain Geek Privacy Policy.

Amendment

This statement is in effect as of November 1, 2024. Green Mountain Geek will from time to time review and revise its privacy practices and this Policy. In the event of any amendment, an appropriate notice will be posted on this website. Policy changes will apply to the information collected from the date of posting of the revised Policy to Green Mountain Geek website as well as to existing information held by Green Mountain Geek.
